GENERAL TERMS AND CONDITIONS OF BUSINESS

1. Scope of application
1.1. These General Terms and Conditions of Business (hereinafter referred to as "T&Cs") of Palais Liechtenstein, Liechtenstein Gruppe AG, Immobilien Wien (hereinafter referred to as "the Palace") apply to all tickets ordered from the Palace webshop, via email, or by telephone, in the version valid as at the time of the respective order. The webshop may be found on the Palace website, at https://www.palaisliechtenstein.com/en or/and at https://www.sommerrhapsodie.at/de/programm-tickets.html
1.2. These T&Cs are published on the Palace website at: https://www.palaisliechtenstein.com/en/agb.html or/and at www.sommerrhapsodie.at/de/agb.html and may be downloaded and/or printed by the customer.
1.3. When ordering tickets, the customer accepts these T&Cs. The T&Cs are therefore an integral part of the contract concluded. Only these T&Cs shall apply. Any derogating terms and conditions shall not be recognized by the Palace and shall therefore not form part of any contract unless the Palace has expressly agreed to such derogating terms in writing.
1.4. The Palace reserves the right to amend the T&Cs at any time.

3. Conclusion of purchase contract
3.1. Orders from the Palace webshop may only be placed online via the user interface on the Palace website www.palaisliechtenstein.com/en or/and www.sommerrhapsodie.at, and only in the German or English language.
3.2. In order to place an order, the online order form must be completed. All required fields marked * on the order form must be completed truthfully, completely and correctly. The customer shall be liable for any costs arising from inaccurate or incomplete information. By clicking on the button "REVIEW ORDER", the data entered by the customer online will be verified for completeness and displayed in overview form. Prior to submitting an order, the customer is required to accept the T&Cs by clicking the button "I ACCEPT THE T&Cs". Submission of an order constitutes a binding offer to conclude a purchase contract on the part of the customer. Following submission of a binding offer, the customer shall receive an email from the Palace sent to the email address as notified by the customer, confirming receipt of the order and the details thereof (order confirmation). Said order confirmation shall at this stage not yet constitute acceptance of the customer's offer by the Palace, but is merely intended to inform the customer that the order has been received. Following acceptance of the customer's offer by the Palace, the customer shall be forwarded a booking confirmation plus terms and conditions of business via email.
3.3. The purchase contract with the Palace shall not take effect until transmission of the booking confirmation, since such confirmation is deemed offer acceptance on the part of the Palace. The booking confirmation is also valid as an entry ticket to the respective guided tour or event booked.
3.4. In the case of tickets ordered by email or telephone, prior to contractual conclusion the customer shall receive a copy of the present T&Cs for information. Clause 3.3 applies by way of analogy.
4. Purchase price, amendments, tickets
4.1. Current prices may be viewed on the Palace website at www.palaisliechtenstein.com/en or/and at www.sommerrhapsodie.at. All price indications are in euro and include statutory value added tax.
4.2. The Palace reserves the right to make price changes. The customer shall be informed of any price changes prior to transmission of the booking confirmation.
4.3. If the Palace cannot accept or execute an order placed because, for instance, no tickets are any longer available, the customer will be informed accordingly by email without delay. Any payments already made will be refunded to the customer.
4.4. Booking confirmations are valid as entry tickets. They must be printed out and brought as booking evidence to the respectively-booked guided tour or event. No additional entry tickets will be sent by post. The customer is responsible for ensuring that entry tickets are legible. The Palace will not accept illegible or incomplete entry tickets.
4.5. The customer may only print one entry ticket for each booking confirmation. Duplication of a booking confirmation/entry ticket is prohibited. The Palace reserves the right to assert claims for damages in the event of a breach of this stipulation. Entry tickets are generally transferable. In the event of transfer, the customer shall ensure that the transferee is aware of the T&Cs. In any event, an entry ticket may only be used once and shall no longer be transferable thereafter.
4.6. Entry tickets may not be offered for resale or sold without the prior written consent of the Palace.
5. Payment options and terms
5.1. Payment in the Palace webshop may only be made by credit card (MasterCard or VISA) via the user interface accessible on the Palace website at www.palaisliechtenstein.com/en or/and at www.sommerrhapsodie.at. Data is transferred in encrypted form and in accordance with current security standards. The credit card details provided by the customer will be transferred only to the credit card company. Once the required details have been provided, and after clicking on the button "BUY NOW", an order becomes binding and can no longer be amended.
5.2. In the case of individual group guided tours booked by email or telephone, payment may be made by bank transfer only to the following Palace bank account:

The Palace will issue a corresponding invoice.
5.3. In the case of tickets purchased by email or telephone, the tickets will be held for collection at the event venue and issued following payment of the outstanding purchase price.
6. Reservation of title
Title to tickets shall be held by the Palace until full payment has been made.
7. Liability/Warranty
The provisions of the Austrian General Civil Code (Allgemeines Bürgerliches Gesetzbuch, ABGB) apply.
8. Cancellation
8.1. Under Section 18 (1) clause 10 of the Austrian Distance and Off-Premises Contracts Act (Fern- und Auswärtsgeschäfte-Gesetz), the customer has no cancellation right in respect of tickets purchased for a specific date and time. However, the Palace offers cancellation options for guided tours. With regard to tickets for other events (e.g. concerts), cancellation is not possible.
8.2. In the case of private group tours booked by email or telephone, the customer has a right to cancel free of charge for a period of 7 days with effect from contractual conclusion, up to 10 days prior to commencement of the individual group guided tour.
8.3. In the case of public guided tours booked online via the user interface provided on the Palace website www.palaisliechtenstein.com, the customer also has a right to cancel free of charge for a period of 7 days with effect from contractual conclusion, up to 7 days prior to commencement of the public guided tour.
8.4. Cancellation must in any event be communicated in writing, using the Palace contact details given in Section 2 above, indicating the name of the orderer, a description of the respective guided tour, and the date booked.
9. Data privacy
All customer data derived from enquiries and orders shall only be used for processing the respective transaction. Data shall only be passed to third parties if required for the purpose of fulfilling contractual duties.
Where the legal preconditions are met, you hold the following rights under the EU GDPR: rights of access, rectification, erasure, restriction of processing, data portability, objection to processing. You have the right to file a complaint with a supervisory authority if you believe that processing of your personal data is not being undertaken in accordance with the law. 10. Terms of Use
By purchasing an entry ticket, the customer agrees to abide by the Terms of Use of the Palace when attending an event or participating in a guided tour. The Terms of Use may be accessed and printed on the Palace website at www.palaisliechtenstein.com. The Terms of Use are also displayed in the entrance area of the Palace.
11. Audio, film, photographic and video recordings by visitors
Audio, film, photographic and video recordings are prohibited for copyright reasons. In the event of non-compliance, staff are entitled to confiscate recording devices and cameras and to retain them until the end of the event in question. Film and recording materials of all types containing parts of a performance/presentation may be confiscated and held. They will be released to the owner once the latter has agreed to deletion of the recordings made.
12. Image and audio recordings by event organizers
Video, image and audio recordings may be made during events by the event organizer or on the event organizer's behalf for the purpose of documenting the event in question. Such recordings may also be used for advertising and marketing purposes, in both printed and electronic form (social media), as well as on radio and television. The event organizer warrants that use of such recordings shall respectively only take place reflecting a positive overall context.
13. Change of event
The right is reserved to make minor and/or objectively-justified lineup/personnel changes or program changes; this shall not entitle ticketholders to return or exchange tickets, nor to receive any price reduction. Announcements concerning the lineup/personnel for an event are not deemed part of the subject matter of the contract concluded between the customer and the event organizer. The event organizer thus expressly reserves the right to make lineup/personnel changes.
14. Event cancellation
Events may be cancelled due to technical failures, orders/conditions imposed by the authorities and/or the courts, illness or unavoidable absence on the part of the artist(s), or adverse weather (in particular hail or storm).
If an organizer's event is cancelled, tickets may be refunded within a period of six months with effect from the event date. Refunds must be requested in writing. Thereafter, all refunds are excluded.
15. Abandonment of an event
If weather conditions do not permit an event to proceed as planned, the event organizer reserves the right to delay commencement of a performance/presentation before a decision and announcement are made as to whether the event may have to be cancelled. The event organizer also reserves the right to suspend a performance/presentation and resume it later. Such decision is incumbent upon the event organizer and shall be made by the event organizer on site.
Postponement of the commencement of an event at short notice shall not entitle a customer to return tickets. It is incumbent upon the customer to ensure that they are informed on the day of the event as to any changes.
If an event is abandoned, the ticket price shall be refunded if, at the time of abandonment, the performance/presentation has lasted less than 45 minutes.
16. Severability clause
In the event that any individual terms of these T&Cs should be invalid or become invalid following contractual conclusion, this shall not affect the validity of the remainder of these T&Cs. Any invalid term shall be replaced by such valid provision as comes as close as possible to the objective pursued by the contracting parties in concluding the invalid term.
17. Concluding provisions
17.1. The contractual relationship between the Palace and the customer based on online orders and all claims arising therefrom shall be subject to the law of the Republic of Austria, to the exclusion of provisions of private international law and UN law on the international sale of goods.
17.2. With regard to any disputes arising from the contractual relationship between the Palace and customers, the court having subject-matter and territorial competence in respect of the registered office of the Palace shall have exclusive jurisdiction.
